Appeals court upholds city's rejection of payday loan store

An Aug. 11 decision by the state Court of Appeals upheld the city of Wauwatosa's 2006 decision to reject an EZMoney Payday Loans store that sought to open at 6502 W. North Ave.

That decision is the latest in a three-year legal dispute between the city and EZCorp Inc. The Texas-based company filed a lawsuit in February 2007 against the city's Board of Zoning Appeals, saying trade district zoning ordinances do not apply to its quick cash loan services. EZCorp said its business falls under a different banking classification than designated in the ordinance.

However, the state court's decision does not necessarily mean an end to the dispute, and for now the long-vacant storefront will remain empty, City Attorney Alan Kesner said in a news release. EZCorp has 30 days to request the state Supreme Court review the decision.

EZCorp's legal department did not immediately respond to a phone call from a reporter seeking comment.
